General principles<\/h2>\n  <p>These return and withdrawal terms apply to goods and services sold or mediated by Gaasikontroll O\u00dc.<\/p>\n  <p>The right of return and the right of withdrawal depend on whether the buyer is a consumer or a legal entity.<\/p>\n  <p>A consumer is a natural person who purchases goods or services for purposes not related to their economic or professional activities.<\/p>\n  <p>If the buyer is a legal entity or the purchase is made for economic or professional purposes, the 14-day consumer withdrawal right does not apply, unless the seller has agreed otherwise in writing.<\/p>\n  <p>By placing an order, the buyer confirms that they have read, understood and accepted these return and withdrawal terms.<\/p>\n  <h2>2. 14-day consumer withdrawal right<\/h2>\n  <p>A consumer has the right to withdraw from a distance contract within 14 days from receiving the goods, unless a legal exception applies.<\/p>\n  <p>If an order consists of several goods delivered separately, the 14-day period begins when the last item is received.<\/p>\n  <p>For services, the withdrawal period begins from the conclusion of the contract.<\/p>\n  <p>To use the right of withdrawal, the consumer must send a clear withdrawal statement to the seller by email: gaasiteenused@gmail.com.<\/p>\n  <ul>\n    <li>buyer\u2019s name;<\/li>\n    <li>order or invoice number;<\/li>\n    <li>goods or service being returned;<\/li>\n    <li>contact details;<\/li>\n    <li>bank account number, if required for the refund.<\/li>\n  <\/ul>\n  <p>The consumer does not have to provide a reason when using the 14-day withdrawal right.<\/p>\n  <h2>3. Condition of returned goods<\/h2>\n  <p>Returned goods must be unused, undamaged, complete and, if possible, in the original packaging.<\/p>\n  <p>The buyer may inspect the goods in the same way as would normally be possible in a physical store.<\/p>\n  <p>The buyer is responsible for any decrease in the value of the goods if the goods have been used more than necessary to establish their nature, characteristics and functioning.<\/p>\n  <p>If the goods have been installed, connected, put into use, soiled, damaged, scratched, opened in a way that decreases their value, or returned incomplete, the seller has the right to reduce the refunded amount according to the decrease in value.<\/p>\n  <p class=\"gk-warning\">If the condition of the goods makes it impossible to sell them as new, the decrease in value may be up to 100% of the price, depending on the actual condition of the goods.<\/p>\n  <p>If factory seals, protective caps, connection plugs, protective films or other protective elements installed by the manufacturer have been removed, and the goods show possible signs of installation, connection, use, water, gas, sealant, scratches, dirt or other traces of use, the goods are no longer considered unused and new.<\/p>\n  <p>In such a case, the buyer is responsible for the decrease in the value of the goods. The seller has the right to reduce the refunded amount according to the actual condition of the goods. If the condition of the goods no longer allows them to be sold as new, or if resale may be technically, economically or from a safety perspective unjustified, the decrease in value may amount to up to 100% of the price of the goods.<\/p>\n  <p>The buyer must pack the returned goods in a way that prevents damage during transport. If the goods are damaged during return due to insufficient packaging, the buyer is responsible for the damage.<\/p>\n  <h2>4. Goods that cannot be returned<\/h2>\n  <p>The right of withdrawal does not apply, among other cases, if:<\/p>\n  <ul>\n    <li>the goods were made or ordered according to the buyer\u2019s special request;<\/li>\n    <li>the goods were clearly adapted to the buyer\u2019s needs;<\/li>\n    <li>the goods were specially ordered specifically for the buyer;<\/li>\n    <li>after delivery the goods were installed, connected or put into use in a way that prevents them from being returned as new;<\/li>\n    <li>after delivery the goods were connected to a gas, water, heating, flue gas, electrical or other technical system;<\/li>\n    <li>due to their nature, the goods have after delivery been mixed, connected or become an inseparable part of another system;<\/li>\n    <li>the goods are not suitable for return for hygiene, safety or technical reasons after opening the packaging or starting use;<\/li>\n    <li>goods from which factory seals, protective caps, connection plugs or other protective elements have been removed and whose condition indicates possible installation, connection or use, if such goods cannot be sold as new;<\/li>\n    <li>the service has been fully performed with the consumer\u2019s prior express consent before the end of the withdrawal period;<\/li>\n    <li>another statutory exception to the right of withdrawal applies.<\/li>\n  <\/ul>\n  <p>Gas boilers, gas water heaters, cylinders, gas meters, flue gas components, connection kits, pipes, taps, valves, seals and other technical components are not returnable if they have been installed, connected, put into use, damaged or are no longer sellable as new.<\/p>\n  <p>If a product has been ordered from a supplier specifically based on the customer\u2019s order and is not kept in the seller\u2019s regular stock, it may be a special-order item. Return of such goods is possible only with the seller\u2019s written consent.<\/p>\n  <h2>5. Incorrectly selected product<\/h2>\n  <p>Before making a purchase, the buyer is responsible for ensuring that the selected product is suitable for the existing system, installation location and technical conditions.<\/p>\n  <p>For gas devices, cylinders, gas meters, pipe components, flue gas systems and other technical products, the buyer must check in advance the model, capacity, dimensions, connections, gas type, water pressure, flue gas solution, ventilation, condensate drainage, electrical connection, suitability of the installation site, manufacturer\u2019s instructions and applicable requirements.<\/p>\n  <p>The seller is not responsible if the buyer selects a product that is unsuitable for the buyer\u2019s existing system, site or technical conditions, unless the buyer ordered a suitability check from the seller or the seller\u2019s cooperation partner before purchase.<\/p>\n  <p>If the buyer wishes, the seller or the seller\u2019s cooperation partner may help assess product suitability under a separate agreement.<\/p>\n  <h2>6. Return costs<\/h2>\n  <p>The buyer bears the cost of returning the goods, except where the reason for return is incorrect or defective goods.<\/p>\n  <p>If the goods cannot be returned by ordinary postal service due to their nature, weight, dimensions or technical character, the buyer bears the costs of return, removal, dismantling, special transport, lifting and packaging, unless the law provides otherwise.<\/p>\n  <p>If the buyer returns the goods via courier, transport company or another carrier, the buyer is responsible for damage or loss of the goods until they reach the seller.<\/p>\n  <p>The seller does not reimburse additional costs resulting from the buyer\u2019s choice of a more expensive delivery method, special transport, express delivery, lifting service, unloading or other additional service, unless the law provides otherwise.<\/p>\n  <h2>7. Refunds<\/h2>\n  <p>If the consumer lawfully uses the right of withdrawal, the seller refunds the amount paid within the period required by law.<\/p>\n  <p>The seller has the right to withhold the refund until the goods have been returned to the seller or the buyer has provided proof that the goods have been sent back.<\/p>\n  <p>Refunds are generally made using the same payment method or to the same account used for the purchase, unless the parties agree otherwise.<\/p>\n  <p>If the value of the returned goods has decreased, the seller has the right to reduce the refund according to the decrease in value.<\/p>\n  <p>The seller has the right to set off from the refund any unpaid invoices, return costs, damages, missing parts, dismantling costs, special transport costs or other costs for which the buyer is responsible, where permitted by law.<\/p>\n  <h2>8. Cancellation of services, installation and call-outs<\/h2>\n  <p>If the buyer orders consultation, inspection, diagnostics, installation, maintenance, repair, connection of equipment, dismantling or another service, the time, scope and price of the service are agreed separately.<\/p>\n  <p>If the provision of the service has begun with the buyer\u2019s prior consent before the end of the 14-day withdrawal period, the buyer is required to pay for the part of the service already provided.<\/p>\n  <p>If the service has been fully performed with the buyer\u2019s prior express consent before the end of the withdrawal period, the buyer may lose the right to withdraw from the service.<\/p>\n  <p>If the buyer cancels an agreed service less than 24 hours before the agreed time, does not provide access to the site, does not answer the phone, or the site is not ready for the work, the seller or service provider may claim reasonable costs.<\/p>\n  <p>If a technician or installer arrives at the site but the work cannot be performed for a reason attributable to the buyer, the buyer must pay the call-out, time spent and other reasonable costs according to the agreement or price list.<\/p>\n  <p>If during the work it becomes clear that the existing system does not comply with requirements, is unsafe, requires additional work or does not allow the ordered device to be installed, the seller or service provider has the right to suspend the work and provide an offer for additional work.<\/p>\n  <p>The seller is not obliged to continue work if doing so may conflict with the law, safety requirements, manufacturer\u2019s instructions or good professional practice.<\/p>\n  <h2>9. Defective goods and complaints<\/h2>\n  <p>If a defect appears in the goods, the consumer has the right to submit a complaint to the seller within the period provided by law.<\/p>\n  <p>The consumer must notify the seller of the defect no later than within 2 months from discovering it.<\/p>\n  <p>Complaints must be submitted in writing by email to gaasiteenused@gmail.com.<\/p>\n  <ul>\n    <li>buyer\u2019s name;<\/li>\n    <li>order or invoice number;<\/li>\n    <li>product name;<\/li>\n    <li>description of the defect;<\/li>\n    <li>time when the defect appeared;<\/li>\n    <li>photos or videos, if they help assess the defect;<\/li>\n    <li>product serial number, if available;<\/li>\n    <li>installer details, if the product has been installed.<\/li>\n  <\/ul>\n  <p>The seller has the right to request additional information, photos, video, manufacturer inspection, expert assessment or device inspection to assess the defect.<\/p>\n  <p>The seller is not responsible for a defect if it was caused by incorrect installation, incorrect use, lack of maintenance, unsuitable system, actions of the buyer or a third party, external damage, dirt, limescale, freezing, electrical problems, insufficient ventilation, unsuitable flue or another circumstance beyond the seller\u2019s control.<\/p>\n  <h2>10. Warranty and installation requirements<\/h2>\n  <p>The manufacturer\u2019s warranty applies according to the manufacturer\u2019s warranty terms.<\/p>\n  <p>The validity of the warranty may depend on whether the product has been properly installed, used according to instructions and maintained according to the manufacturer\u2019s requirements.<\/p>\n  <p>Installation, connection, maintenance and repair of gas devices, heating equipment and other technical equipment must be performed by a competent person where required by law or manufacturer instructions.<\/p>\n  <p>The buyer must be able to prove, where necessary, that the device has been installed and maintained properly.<\/p>\n  <p>The warranty does not cover defects caused by incorrect installation, incorrect use, lack of maintenance, failure to follow manufacturer instructions, unsuitable system, insufficient ventilation, unsuitable flue gas solution, water pressure or water quality problems, power outages or voltage fluctuations, freezing, limescale, dirt, blockages, third-party repair or modification, or normal wear and tear.<\/p>\n  <h2>11. Returns by legal entities<\/h2>\n  <p>A legal entity or a buyer acting in economic or professional activity does not have a 14-day withdrawal right.<\/p>\n  <p>Cancellation, amendment or return of an order by a legal entity is possible only with the seller\u2019s written consent.<\/p>\n  <p>The seller has the right to refuse a return by a legal entity if the goods were specially ordered, purchased from a supplier, opened, used, installed, damaged or are no longer sellable as new.<\/p>\n  <p>If the seller agrees to a return by a legal entity, the seller may deduct costs related to return, handling, inspection, transport, repackaging and decrease in value.<\/p>\n  <h2>12. Partners and intermediaries<\/h2>\n  <p>To fulfil an order, process an enquiry, organise a service, coordinate installation, resolve warranty matters or protect the seller\u2019s legitimate interests, the seller may use cooperation partners and intermediary companies, including Andivest Grupp O\u00dc.<\/p>\n  <p>Only necessary information is transferred to the partner and only to the extent required for the specific task.<\/p>\n  <h2>13. Final provisions<\/h2>\n  <p>The seller aims to resolve all return and complaint matters reasonably and in good faith.<\/p>\n  <p>These terms do not restrict the consumer\u2019s statutory rights.<\/p>\n  <p>If any provision of these terms is invalid or conflicts with a mandatory legal provision, this does not affect the validity of the remaining terms.<\/p>\n  <p>Estonian law applies to these terms.<\/p>\n  <h2>14.
